Literature Review: Family problem for Justice

This “Ten Problems for Justice in the 2020s” booklet identifies ten relevant areas from very recent contributions put forward at academic level in the form journal articles, conference proceedings and students theses. Ten freely accessible internet references have been selected for each area and direct links are provided at the end of each chapter for own consultation. Our selected references do not intend to mirror ranking indexes nor establish novel classifications. On the contrary, they are meant to represent peer-reviewed, diverse and scientifically-sound case studies for vertical dissemination aimed at non-specialist readers. They will also be able to scoop even more references through the bibliography that is reported at the end of each selected reference.

Without further ado, these are the ten problems that we are going to introduce in this booklet:

  1. policies,
  2. criminal,
  3. financial,
  4. drugs,
  5. environmental,
  6. violence,
  7. family,
  8. open access,
  9. artificial intelligence,
  10. diversity.

Each problem has its own dedicated chapter made of an introductory section, a short presentation of the ten selected references and a conclusions section.

The final chapter of this booklet will report the conclusions from each chapter again in order to provide a complete executive summary.

THE PROBLEM — While the United Nations Convention on the Rights of the Child has widespread acceptance, we are less sure about other concepts. Broader substantive issues of family justice may, at times, be hotly contested. Family law has historically been an area that many people end up traversing with only limited legal assistance or non-enforcement.

CONCLUSIONS — Family solidarity is a phrase commonly used by continental Europeans where its heritage is longstanding, it is heard less in the common law world. Robust research evidence remains in its infancy regarding many key topics in family law. With increasing interest in artificial intelligence in legal services has come an expanding range of family law applications. Each year family courts incarcerate thousands of Americans for nonpayment of child support. While showing some similarities to family therapy, ecosystemic family mediation is a discrete process with clearly defined principles and boundaries. Supervision orders are an important legal option in the United Kingdom for local authorities and the courts, in case of child reunification. Domestic violence is a social problem that impacts many Americans and affects marginalized individuals and communities disproportionately. The question of how culture and ethnicity enter the courtrooms still remains empirically under-researched and lacks theoretical systematization. In the United Kingdom, the impact of austerity on access to justice has been especially grave for women. Paternal incarceration in Canada contributes to economic, social, and health inequalities which are associated with physical and mental health as well as, food insecurity.
